Terms of use
What you agree to
GigaRetro is an app by Bandsoft for playing, with emulators, the games you load on your phone, with a community chat, private channels, tournaments, online play and optional purchases. By using it you agree to these terms and to the privacy policy, which explains what data we process. If you don't agree, don't use the chat or the purchases: the rest of the app works on your phone without an account.
Minimum age
You must be at least 13 to write in the chat (16 if you live in the European Union). The app asks before letting you write; if you're younger, you can read but not write.
Chat rules
They are the same rules the app shows before you write, and they apply in Global, in private channels and in tournaments:
- No sharing games or download links, not even in private channels. Only links to itch.io, GitHub and PDRoms (free homebrew games) are allowed. If you like a game, use the «Recommend» card.
- Be respectful in chat and in games: no insults, harassment, threats, hate, or sexual or violent content.
- No spam, and don't pretend to be someone else, a moderator or GigaRetro.
- Your nickname and the names and descriptions of your channels follow the same rules.
- If you see something that breaks them, long-press the message to report it.
Private channels
- Whoever creates a channel is its owner: they can appoint moderators, pin messages, turn on slow mode, and mute and kick members. They and their moderators look after the rules.
- Private channels are not encrypted. If someone reports them, GigaRetro's moderators can read them and take action, just like in Global.
- A channel inactive for a long time is archived, and a channel that breaks the rules may be deleted.
Your content
You are responsible for what you write and share (messages, cards, pads, macros, rooms, nicknames and channels). It remains yours, but you allow us to store it and show it to the people in the channel for as long as the chat keeps it (the last 200 messages of each channel). Don't share your own or anyone else's personal data. You can delete your chat data at any time (chat › «i» › «Delete my chat data»).
Moderation and penalties
GigaRetro's moderators may, without notice and depending on how serious it is:
- hide or delete messages and cards (a message with several reports is hidden automatically until it's reviewed);
- turn on slow mode in a channel; in Global it also turns on by itself when traffic is heavy, and turns off by itself when it drops;
- mute your account for a while, in the whole chat or in one channel;
- kick you from a private channel, delete a channel and, for serious or repeated breaches, stop you from using the chat.

Games
GigaRetro does not include, host or link to commercial games. Each player loads their own on their phone and must have the right to use them; those files never go through our servers. The bundled homebrew games are included with their authors' permission or free license.
Purchases and GigaRetro Plus
- GigaRetro Plus and cosmetics (style packs, nickname color, stickers, badges) are bought through Google Play; payment, refunds and their deadlines follow Google Play's terms.
- What each purchase gives is checked and decided by our server with Google Play: a purchase counts once the server confirms it, and a refunded or voided purchase stops giving what it gave.
- Purchases are tied to your player account. With Play Games they follow you to other phones; Google Play restores them if you delete your data or reinstall the app.
- The emulator basics are free (playing, saving, online play and the chat); GigaRetro Plus extends some features. Using apps or tricks to get around purchases or ads doesn't entitle you to anything that is sold and may lead to the chat penalties above.
- Plus's cloud backup is for your own saves: using it to store or share games, BIOS files or any other files is forbidden (the app doesn't allow it and the server rejects it). Without Plus it is read-only for 90 days and then deleted; it is not a guaranteed backup, so don't rely on it alone.
Copyright and content removal
If something in the chat or in GigaRetro uses your work without permission, or you'd rather it not appear, follow the copyright and content removal procedure (in Spanish, with an English summary): we reply within 72 hours and hide chat content as soon as we receive the request.
No warranty
GigaRetro is provided «as is». We do our best for it to work well, but we don't guarantee that every game works or that the chat, online play or servers are always available or error-free. To the extent the law allows, we are not liable for lost saves, data or playtime. Nothing here limits the rights the law gives you as a consumer.
Changes to these terms
We may change these terms (for example, if the rules or purchases change). The date above says when they last changed; if it's an important change, we'll announce it in the app. Continuing to use the chat or the purchases afterwards means you accept the new terms.
